THE SUMMONS EMAIL CONFIRMED

"The email you referenced below was sent to an individual parent who has contacted the superintendent, the board members, and me multiple times regarding masking. I have received emails from parents on both sides of the masking debate and have corresponded with most, if not all. Because this parent has a child who is immunocompromised, I gave the parent a head’s up that the masking decision would be on the agenda for discussion in case she wanted her viewpoint to be heard."

THE 10.12.21 LETTER, THE ALLEGATIONS, AND THE BAN

On 9.27.21 Mr. Cain was removed by an Oldham County Police Officer
Mr. Cain's outbursts were unacceptable and unsafe
His actions were deemed unacceptable and unsafe by the Board
Mr. Cain was banned until January 2022
Mr. Cain was also banned from campus before and after public Board meetings
Any violations of the conditions in the letter may result in arrest for trespassing, harassment, and/or menacing (bolded for emphasis in the letter)
Accusation of Mr. Cain creating a hostile or unsafe environment
All measures mentioned in the letter are necessary to endure safety and order
Mr. Cain was prohibited due to his actions at the "last meeting" (9.27.21).
- No mention was made regarding his actions or behavior of any prior meetings including any meetings in August 2021

THE 10.12.21 REBUTTAL EMAIL FROM
MR. CAIN TO MR. DAVIS

Mr. Cain was never removed for an outburst.
- This rebuttal was not contested by Mr. Eric Davis
Mr. Cain was instead removed by Mr. Deaves for exceeding the allowed time of 2 minutes
- This rebuttal was not contested by Mr. Eric Davis
Mr. Cain respectfully left after being asked to leave by Mr. Deaves
- This rebuttal was not contested by Mr. Eric Davis
Mr. Cain was never approached by a police officer and/or escorted out
- This rebuttal was not contested by Mr. Eric Davis
Mr. Cain used no profanity and did not call anyone any names

Mr. Eric Davis replied to the rebuttal in "strong support of your advocacy"
Mr. Eric Davis replied to the rebuttal that he "agreed with many of your points"

Micah Cain has won his lawsuit against the Oldham County Board of Education for infringement of his First Amendment rights to freedom of speech. OCBE has agreed to all his demands regarding this lawsuit.
